AUCTION TERMS & CONDITIONS

130 Copperfield Dr., Chillicothe, OH

1. AUCTION FORMAT & AUTHORITY

This property is offered for sale via hybrid auction conducted by ERA Martin & Associates, with Daniel DeGarmo serving as Auctioneer & Real Estate Agent (“Auctioneer”). The auction includes online bidding at www.eramartinauctions.com and live, on-site bidding at the property.

The Auctioneer is acting as agent for the Seller and has full authority to conduct the auction, regulate bidding, resolve disputes, determine the winning bidder, and enforce these Terms & Conditions. The Auctioneer’s decisions are final and binding.

2. AUCTION SCHEDULE

Auction Begins: Online bidding is open and begins today
Online Auction Ends:
Saturday, January 31st at 12:00 PM, subject to soft close
Soft Close: Any bid placed in the final five (5) minutes will extend bidding by five (5) minutes until no further bids are received
Live On-Site Bidding:
Saturday, January 31st at 2:00 PM, at the property

The Seller and Auctioneer reserve the right to modify the auction format, bidding method, or schedule at any time prior to or during the auction.

3. OPENING BID

Bidding will open at $25,000. The opening bid is not a representation of value and does not reflect a minimum acceptable price.

4. BUYER’S PREMIUM & PURCHASE PRICE

A 10% Buyer’s Premium will be added to the final high bid or Buy-It-Now price to determine the total contract purchase price.

The Buyer’s Premium shall serve as earnest money upon seller confirmation and will be non-refundable, except in the event of Seller default.

5. SELLER CONFIRMATION

All bids are subject to Seller confirmation. Seller reserves the absolute right to:

Accept or reject any bid or offer
Accept an offer prior to auction conclusion
Withdraw the property from auction at any time

No sale is final until Seller confirmation is granted and acknowledged.

6. BUY-IT-NOW OPTION

A Buy-It-Now price of $180,000 is available. If exercised, the auction will immediately conclude, and the Buyer will be bound by all auction Terms & Conditions.

7. REGISTRATION & BIDDER RESPONSIBILITY

All bidders must properly register and be approved prior to bidding. By placing a bid, the bidder:

Certifies that they have the legal authority and financial ability to complete the purchase
Acknowledges receipt and acceptance of these Terms & Conditions
Agrees that their bid constitutes a legally binding offer to purchase

Bidders are responsible for ensuring their bids are accurately entered. No bid may be retracted.

8. FINANCING

Financing is permitted; however, financing must be secured prior to bidding. The sale is not contingent upon financing, appraisal, inspection, or sale of another property.

Failure to close due to financing issues shall constitute Buyer default.

9. PROPERTY CONDITION & INSPECTIONS

The property is being sold AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranties or representations, expressed or implied, including but not limited to condition, habitability, zoning, permitted use, or compliance with laws.

Buyers are solely responsible for:

Conducting all inspections and due diligence prior to bidding
Verifying square footage, boundaries, utilities, zoning, and condition

By bidding, Buyer waives all rights to claims, rescission, or price adjustments based on property condition.

10. CLOSING & TITLE

Closing: Within thirty (30) days of Seller confirmation
Title Company: Northwest Title, Chillicothe, Ohio
Seller to provide title insurance
Seller to pay property taxes to closing
Title conveyed by General Warranty Deed

Failure to close on time shall constitute Buyer default.

11. POSSESSION & RISK OF LOSS

Possession shall be granted to Buyer at closing. Risk of loss remains with the Seller until closing and transfer of possession.

12. SURVEY

No survey will be provided. Property boundaries and acreage are approximate and based on public records. Buyer accepts the property subject to any and all easements, restrictions, and rights-of-way of record.

13. DEFAULT & REMEDIES

If Buyer fails to perform, including failure to close:

Buyer’s earnest money (Buyer’s Premium) shall be forfeited as liquidated damages
Seller may pursue specific performance or additional legal remedies
Buyer shall be responsible for all costs of enforcement, including attorney fees

14. AGENCY DISCLOSURE

ERA Martin & Associates and Daniel DeGarmo, Auctioneer & Real Estate Agent, represent the Seller only. No agency relationship exists with the Buyer.

15. ANNOUNCEMENTS & GOVERNING AUTHORITY

All announcements made by ERA Martin & Associates and Daniel DeGarmo online, in person, or on auction day take precedence over all prior advertising, printed materials, or website content.

This auction is governed by the laws of the State of Ohio. Venue for any dispute shall be the county in which the property is located.

16. ACCEPTANCE OF TERMS

Participation in the auction constitutes full acceptance of these Terms & Conditions. No exceptions will be made.
